The Complete 2026 Guide

The key insight:

Your gratuity is not a bonus. It is deferred pay you have already earned, and most professionals leave money on the table because they never check the maths.

End of service gratuity is one of the largest single payments most professionals in the UAE will ever receive from an employer, and it is also the one they understand least. It is not a goodwill bonus and it is not discretionary. It is deferred pay, written into federal law, that you accrue for every year you work. The problem is that the amount sitting in your file rarely matches the amount in your head, because the calculation runs on basic wage rather than the salary you actually negotiated.

This guide sets out exactly how gratuity works in the UAE in 2026, what changed under the current labour law, and how to read your payout as part of your total market worth rather than as an afterthought on your final payslip.

How gratuity is calculated

The formula is fixed in federal law and applied through MOHRE. For a standard full time contract it works in two tiers.

For the first five years of service, you earn 21 days of basic wage for every completed year. For every year beyond five, you earn 30 days of basic wage. Your daily wage is your monthly basic salary divided by 30. Partial years accrue proportionately once you have crossed the one year threshold, so a departure at four years and seven months is not simply rounded down to four.

Two limits matter. You need at least one full year of continuous service to qualify at all, and the total payout can never exceed two years of basic wage, however long your tenure.

1 to 5 years21 days per completed yearBasic wage
Over 5 years30 days per completed year (for years beyond five)Basic wage
Any lengthCapped at 2 years of basic wage totalBasic wage

The single most important word in that table is basic. Gratuity excludes housing, transport, and other allowances, along with overtime, bonuses, and in kind benefits. In many UAE packages the basic wage is deliberately set at half or less of the total, which quietly halves the gratuity you accrue. If you are negotiating an offer, the split between basic and allowances is not cosmetic. It decides how much of your package converts into a protected, law backed payout when you eventually leave.

What the current law changed

The most consequential change under the current labour framework is the removal of the resignation penalty. Under the older system, a professional who resigned rather than being terminated could see their gratuity cut on a sliding scale, sometimes to a third or two thirds of the full figure, depending on years served and contract type. That penalty is gone for standard contracts. If you have completed at least one year and served your notice correctly, resignation and termination now produce the same gratuity.

The law also stopped distinguishing between limited and unlimited contracts for gratuity purposes. The same calculation now applies across standard full time contracts regardless of how your paperwork was categorised in the past. One practical caveat remains: periods of unpaid leave are excluded from your length of service, so extended unpaid absences reduce the tenure the formula runs on.

A worked example

Consider a professional on a monthly basic wage of AED 30,000, leaving after exactly six years of continuous service.

For the first five years, the accrual is 21 days per year. Twenty one days of a 30,000 basic works out at AED 21,000 per year, so five years produces AED 105,000. For the sixth year, the rate rises to 30 days, which is AED 30,000. The total gratuity is AED 135,000, well within the two year cap of AED 60,000 times 24, or AED 720,000.

Now change one thing. Suppose that same professional earns AED 30,000 in total, but the contract sets basic wage at only AED 15,000 with the rest paid as allowances. Every figure above halves. The six year gratuity falls to roughly AED 67,500 on identical total pay. Same job, same tenure, same money in the bank each month, and half the end of service payout. That is the structural point most people miss.

What your gratuity says about your total package

Gratuity is a window onto how your package is built, and it is worth reading deliberately. A low basic wage inflates the headline number on your offer letter while thinning the protected, deferred portion you walk away with. When you weigh two offers, or when you decide whether to move at all, the basic to allowance split belongs in the calculation alongside salary, bonus, and benefits. This is the same discipline that separates senior professionals who know their market worth from those who accept the first structure they are handed.

How to protect what you are owed

A few habits keep your gratuity where it belongs, which is with you. Keep your own record of your start date and your basic wage as stated on your contract, not your total salary. Check that unpaid leave has not quietly eroded your service length. Serve your notice properly, because failing to do so can put both your gratuity and your reputation at risk. And when a new offer arrives, model the gratuity before you sign, because the structure is far easier to negotiate on the way in than on the way out.

For the wider view of how base pay, bonuses, and benefits fit together at senior level in the Gulf, our guide to total compensation beyond base salary covers the parts of a package that professionals most often undervalue, and our UAE salary benchmarking guide shows how to establish what you are genuinely worth in this market. Key Takeaways

  • UAE gratuity is deferred pay set in federal law: 21 days of basic wage per year for the first five years, then 30 days per year beyond five, capped at two years of basic wage.
  • It is calculated on basic wage only, so a low basic to allowance split can halve your payout on identical total pay.
  • Resignation no longer reduces gratuity for standard contracts, and the limited versus unlimited distinction has been removed.
  • You need at least one year of service to qualify, and unpaid leave is excluded from the tenure the formula uses.
  • Treat gratuity as part of your total package and model it before you sign, not after you resign.

Frequently Asked Questions

What is the minimum service period to qualify for gratuity in the UAE?

You must complete at least one full year of continuous service with the same employer. Below twelve months, no statutory gratuity is due. Once you pass one year, later partial years accrue on a pro rata basis.

Is UAE gratuity calculated on basic salary or total salary?

On basic wage only. Housing, transport, and other allowances, along with overtime and bonuses, are excluded from the calculation. This is why two people on the same total package can receive very different gratuity amounts.

Does resigning reduce my gratuity in 2026?

No. Under the current UAE labour law, resignation no longer cuts your gratuity for standard full time contracts. As long as you have completed at least one year and served your notice, you receive the full amount.

Is there a maximum gratuity payout?

Yes. Total end of service gratuity cannot exceed the equivalent of two years of basic wage, regardless of how long you have served.
